Union, Mo. – The Franklin County woman pardoned herself for her participation in the US capital uprising on January 6, 2021 on Wednesday was sentenced to 10 years in prison for her role in a deadly drunk driving breakdown.
On January 5, 2022, Emily Hernandez drove the wrong way in the eastbound lanes of Interstate 44 for several miles as she crashed into a Buick SUV bearing Victoria “Vickie” N. Wilson, 32, and Ryan E. Wilson, 36 . Vickie was killed. Ryan, who was seriously injured and goes with a sugar cane today, said he is living in constant pain.
Ryan Wilson described in court moments after the crash and how he reached out to Vickie in the passenger seat.
“No matter how loud I cried to her, I couldn’t wake her,” he said. “I couldn’t reach her because of the airbakes.”
Hernandez sat stoically staring at the front with his hands attached to the lap when Wilson turned to court. He was among several of Vickie Wilson’s relatives to tackle the court.

Her mother, Tonie Donaldson, said Vickie’s death “is the first thing I think about in the morning and the last thing I think about every night.”
“When I lost Vickie, I lost part of me,” Donaldson said.
Franklin County -judge Ryan Helfrich sentenced Hernandez to 10 years for Vickie’s death and 7 years for injuries caused by the crash. The setings must be served simultaneously.
A preliminary respiratory test showed that Hernandez had a blood alcohol content of 0.20% after the crash, authorities said. The legal limit for driving a vehicle in Missouri is 0.08%.
Helfrich charged close to the maximum sentence allowed in the two crimes. “Trial period is not appropriate considering the nature of what happened,” he said.
Hernandez’s lawyer had asked for a 120 -day “shock time” in Franklin County prison, with credit for the time she used an electronic screen, followed by probation. Hernandez had previously rejected a plea who would have sentenced her to 12 years in prison.
“What I did was wicked, and I want to live with that shame for the rest of my life,” said Hernandez at the penalty. “I’m sorry I did and if I could take it all back, I would.”
Hernandez was shown in a photo from the 2021 riots at the US Capitol and held a name tag to the then-house speaker Nancy Pelosi. She had traveled to Washington that day with his uncle and his friend to see President Donald Trump’s speech and then marched with the crowd to Capitol.
The deadly crash took place 6 days before Hernandez was scheduled to invoke a wrongdoing with a wrongdoing to get in and back into a limited building. She was sentenced to 30 days in prison, but was pardoned by Trump last week.
