This is an evolving story and will be updated.

A jury in Sullivan County found Megan Boswell guilty of first -time murder in the death of her daughter, 15 -month -old Evelyn Boswell.

Boswell was found guilty of February 13 by other charges, including abuse of children, neglect, manipulation with evidence, abuse of a corpse and several counts of making false police reports. The jury considered only a few hours before reaching a verdict.

The same jury will now decide her criminal. Prosecutors did not seek the death penalty for Boswell.

The Blountville case received national attention in 2020 after the Tennessee Bureau of Investigation issued an Amber Alert for Evelyn, and Megan Boswell gave TV interviews, even when police said she changed her story about the baby’s whereabouts.

“She told the story after story for two and a half months, and maybe the worst part is that she just continued with her life, as if Evelyn had never even existed,” said Sullivan County Assistant District Attorney Amber Massengill in the trial’s final statement. . Evelyn was a real person, and Megan Boswell should not be able to continue as if Evelyn did not exist. “

A magnificent jury accused Boswell in August 2020 on 19 charges, including murder and worsening abuse of children.

Prosecutors argued about the week’s long trial that Boswell was killing Evelyn, put her body in a trash and hid the body in a playhouse on her father’s property.

Massengill said evidence showed that Boswell was the only person responsible for Evelyn’s death, though she told the jury that there are certain aspects of the case that nobody except Boswell knows. Medical investigators testified that the child probably died of suffocation and was found in a trash with aluminum foil tightly wrapped in her face.

Boswell’s defense attorneys said Evelyn could have died for natural reasons and that the toddler was never abused by her mother. They called Witnesses who testified that Boswell was a good mother and took her daughter to regular medical control.

“She’s 17 years old. She’s not sophisticated. She’s had a hard life. She’s afraid she’ll get in trouble,” said defense lawyer Gene G. Scott Jr. under closing statements. He argued that the child’s death was unintentional, Boswell panic and Boswell’s girlfriend hid the child’s body in the trash.

“Have they proven that she is a liar over and over again? They have it. We don’t deny it. They haven’t proven to be a murderer,” Scott said.

Boswell was 17 at the time of the child’s death in late 2019 and 18 when she was arrested several months later.

Witnesses included former babysitters, Boswell’s foster mother, medical professionals, police and Boswell’s friends and family members.

Babysitter Sue Whitson testified that she was concerned about Evelyn’s condition before the toddler disappeared.

“I had never seen a diaper rash so badly,” Whitson said.

Boswell’s palm print and fingerprints were found on the trash where Evelyn’s body was found and on the aluminum foil packed around the body, according to TBI tests.

Scott said it didn’t show she was responsible. Prints could have been there from everyday use before Evelyn died, he argued. Prosecutors disagreed.

“Who was a fingerprint on that trash bag? Megan Boswell’s fingerprints, and you heard (forensic expert Dr. Darinka Mileusnic) says you can see for yourself that the Recycle Bin is not just gently placed inside the Recycle Bin it has become strong … push down compressed, and that’s how Megan Boswell’s fingerprints were placed on that trash.

“More cursed than that, Megan Boswell’s fingerprint was found on the tin foil packed around Evelyn’s head,” Massengill told the jury leader.

Boswell, now 23, did not testify at the trial.
